In my situation, I had a wife who cheated (long term hidden boyfriend), threw me out the house, changed the locks, had an alarm sytem installed, ed the cops on me, 13 years of marriage with zero abuse, and suddenly I am a menace to her. However, if you truly love and care aboutsomeone It is your duty to tell them the truth. Then, of course they make their own bed. The uncle could be wrong and it may work out, but if it doesn't then "I told you so", is in order. I just wish people would have stopped being polite to me, pulled me aside and let me know the deal about marriages. It may not have changed my mind at the time, but I would have won a trusted friend for the next bad decision.

The only clauses that can't be included within a properly constructed prenup are: A waiver of child support. A unconscionable distribution of assets in which x party gets everything and the other gets nothing. Otherwise, you can insert custody/visitation within it and have it enforced, absent child abuse, etc.

Okay, bare with me..... A couple meets, falls in loves, and decides to get married, right? They agree and draft up a prenup that they both agree on. In this prenup it specifies that if they are to have children, both parties will receive joint physical custody and x/x shared parenting time. Through the course of the marriage, things get bad. One of the parties becomes a major alcoholic and is verbally abusive towards the other spouse. They end up filing for divorce. The non-alcoholic parent takes the child/children with him/her because it is what is best for them. You're telling me that because X amount of years ago, joint custody was put in a prenup, a Judge would uphold that decision and force x/x shared parenting and joint custody when one of the parties is instable and a potentially damaging to the child/children?

With a properly constructed prenup absent abuse of the children, yes. A prenup can be contested, but it will (if properly constructed) be uphelp absent child abuse. If a party has a history, demonstrated and proveable, of substance abuse that would fall under the umbrella of potential abuse. Yet, as everyone knows parties make accusations in marriage that are, in many instances, patently absurd and perjury. A history of abuse is not established by a parties accusation. It would be established by substance abuse rehab or similar issues.

I plan to never marry again, but if I did I'm with Doppler, a prenup it is and very specific. But why marry anyway. If two people are committed to one another, no amount of paper is going to change the way they feel for another another. It only protects one or the other. I have a couple who have been together x yrs. Both were married over x yrs and their xst marriages ended. They say a piece of paper isn't going to do anything they aren't already doing.
