Help Is this Really the Law? Are you kidding Me! To My Neice>>How much debt did you get settled with? The answer to that question is supposed to be nothing accept for my stuff (student loans, car), but Washington state law on this is SO LAME. I had to do my own divorce because I didn’t have money for a Lawyer but I was VERY careful. It’s in the paperwork that he is responsible for ALL his debts (we never had any joint debts) and I am supposed to be “held harmless from collection” according to the box I checked in the paperwork. In Washington there is law that the other party is just as responsible for debts incurred during the marriage even if there name is not on it and they don’t even have to be aware of it. Which is all okay since I made him responsible for repaying everything in the divorce papers… but there is a loop hole in the law that’s says all that means is I have the right to sue him for the money back that is collected from me afterwards. SUCKS! I ed every free law advise place and spoke to the court administrator and they all said that is absolutely correct… all it means is he is financially responsible and I have to sue him for my money back because anyone can still collect from me. Then what is the point in the “HELD HARMLESS FROM COLLECTION” box to check in the paperwork? Crazy! So he is unemployed and I am stuck with a good 16 thousand dollars of HIS collections accounts that can surprise me at anytime… unless he starts working again at which point they would go after him first. So for now they find me L Of course they take 25% after taxes only and don’t care about the fact that I carry medical, dental, vision, or 401K so my 1300.00 biweekly paycheck nets 400.00 who can live off of 800.00 a month with two ? How unfair! Meanwhile XXXXX lives at home with his mom and has no plans to get a job anytime soon WHAT A JERK! SO between 600 bucks a month in wage garnishments and 570 in child support I’m not getting there is 1170.00 of normal income GONE! So even with cutting out all of the luxuries there just isn’t enough to pay bills or even buy groceries! Hence the second job I am starting! Is this right? Is Washington really this Crappy nowdays? Why did she let it get to the point of garnishment? That probably added legal fees to. I would sue him. The judgement would be ready when and if he gets a job or any assets. This is one reason I am amazed when people come on here looking to divorce someone they haven't seen in five years. I guess people don't realize they are responsible for their spouses debts and judgements.
